Is Medical Marijuana (MMJ) legal in Massachusetts?

Yes.  Massachusetts voters decriminalized the use of medical marijuana in 2008 and legalized its use for medical purposes in 2012.  Patients may possess a 60-day supply of the medicine for personal use.


Is Recreational Cannabis legal in Massachusetts?

Yes. Voters approved recreational use of marijuana for Adults 21 and older in November 2016.  Under theses laws an adult may carry one ounce of marijuana or possess up to 10 ounces in your home.

Cultivation Tiers Defined:

Massachusetts licensees may not have a total canopy of more than 100,000 square feet.  The tiers for cultivators are listed below.

Tier 1        up to 5,000 square feet

Tier 2        5,001 to 10,000 sq. ft. 

Tier 3        10,001 to 20,000 sq. ft.

Tier 4        20,001 to 30,000 sq. ft.

Tier 5        30,001 to 40,000 sq. ft

Tier 6        40,001 to 50,000 sq. ft.

Tier 7        50,001 to 60,000 sq. ft.

Tier 8        60,001 to 70,000 sq. ft.

Tier 9        70,001 to 80,000 sq. ft.

Tier 10        80,001 to 90,000 sq. ft.

Tier 11        90,001 to 100,000 sq. ft.


Massachusetts License Types


Restrictions:

Adults who are 21 or older can grow up to six plants for personal use or twelve plants maximum for 2 or more adults in a locked area of their home.

Cultivator Licensing fees in Massachusetts vary based on licensed tier. 


Outdoor Application Fees range from $100 to $1,500

Indoor Application Fees range from $200 to $2,000

Outdoor Annual License Fees range from $625 to $25,000

Indoor Annual License Fees range from $1,250 to $50,000

Package and Label Requirements

Adult Use packages must contain producer information, appropriate warning statements, batch and weight information, potency information and usage information.  


If Medical packages are labeled they must contain information about contaminants, cannabinoid profile or potency information.  Medical labels must be verified by a cannabis testing facility.
